Despite spending much of the past two years in a “virtual” world, the predominance of workplace romances has increased over the course of the COVID-19 pandemic.  According to one survey, 25% of U.S. employees either began a new workplace romance during the pandemic or continued an existing workplace romance that began prior to the pandemic.  While dating in the workplace was once a taboo topic, many employers have recognized the likelihood of such relationships occurring and have opted for policies expressly permitting such relationships (at least amongst peers) and encouraging transparency through disclosure and the use of “love” contracts.  Even with such policies in place, there is little incentive for those in a direct reporting relationship to disclose their romance to their employer.  This type of relationship presents the greatest area of legal risk for employers, particularly in an environment such as this where there is likely to be a significant digital footprint left behind.  This session will review the practical and legal implications associated with office romances, discuss recent legal developments, and provide guidance for lessening the organizational impact of consensual relationships, encouraging self-disclosure by employees of these relationships, and minimizing legal exposure when those relationships fail.
